Domavix is an online property management service, published by ABE-HR (15 square François Riga 1030 Schaerbeek, BELGIUM, BCE number: BE0635862615), accessible at domavix.com.

Any use of Domavix implies full acceptance of these Terms of Service (ToS).

Definitions

• "Domavix": the online service and/or its publisher.
• "User" or "Client": any individual or legal entity registered on Domavix.
• "Owner": the User who manages real estate properties through the Service.
• "Tenant": a person whose information is managed by an Owner in the Service.
• "Service": all features offered by Domavix.
• "Account": the User's personal space on Domavix.

Service description

Domavix is a SaaS property management application allowing management of properties, tenants, rents, PDF receipts, deadlines, messaging, bank synchronization via Ponto, and maintenance requests.

Account creation and access

4.1 Registration requirements

The User must be at least 18 years old, provide a valid email address, and accept these ToS.

4.2 Account responsibility

The User is solely responsible for the confidentiality of their credentials. In case of unauthorized use: support@domavix.com.

User obligations

• Use Domavix in accordance with its purpose
• Not use the Service for illegal purposes
• Not attempt to access other Users' data
• Comply with applicable legislation, including GDPR

Bank synchronization (Ponto)

The bank synchronization feature is provided by Ibanity / Isabel Group SA, licensed by the National Bank of Belgium. Domavix never has access to the User's banking credentials.

Service availability

Domavix strives to keep the Service available 24/7. Occasional interruptions may occur for maintenance or force majeure.

Liability

Domavix's liability is limited to the amount of subscriptions actually paid in the past 12 months. For free plan users, liability is limited to €50.

Intellectual property

Domavix and all its components are the exclusive property of ABE-HR. The subscription grants a personal, non-exclusive, non-transferable right of use.

Suspension and termination

Domavix reserves the right to suspend access in case of ToS violation. The User may delete their account at any time from Settings.

Force majeure

Neither party can be held liable in case of force majeure. If the event lasts more than 30 days, either party may terminate without compensation.

ToS modifications

Domavix may modify the ToS at any time. Users will be notified by email at least 15 days before changes take effect.

Applicable law and jurisdiction

These ToS are governed by Belgian law. The competent courts are those of the judicial district of Brussels. Contact: support@domavix.com

Beschrijving van de dienst

Domavix is een SaaS-applicatie voor vastgoedbeheer waarmee u eigendommen, huurders, huurbetalingen, PDF-kwitanties, termijnen, berichten, banksynchronisatie via Ponto en onderhoudsvragen kunt beheren.

Aanmaken van account en toegang

4.1 Registratievoorwaarden

De Gebruiker moet minimaal 18 jaar oud zijn, een geldig e-mailadres opgeven en deze AGV aanvaarden.

4.2 Accountverantwoordelijkheid

De Gebruiker is als enige verantwoordelijk voor de vertrouwelijkheid van zijn inloggegevens. Bij ongeoorloofd gebruik: support@domavix.com.

Verplichtingen van de Gebruiker

• Domavix gebruiken overeenkomstig het beoogde doel
• De Dienst niet voor illegale doeleinden gebruiken
• Niet proberen toegang te krijgen tot gegevens van andere Gebruikers
• De toepasselijke wetgeving naleven, inclusief de AVG

Banksynchronisatie (Ponto)

De banksynchronisatiefunctie wordt aangeboden door Ibanity / Isabel Group SA, erkend door de Nationale Bank van België. Domavix heeft nooit toegang tot de bankgegevens van de Gebruiker.

Beschikbaarheid van de dienst

Domavix streeft ernaar de Dienst 24/7 beschikbaar te houden. Occasionele onderbrekingen kunnen voorkomen voor onderhoud of overmacht.

Aansprakelijkheid

De aansprakelijkheid van Domavix is beperkt tot het bedrag van de abonnementen betaald in de afgelopen 12 maanden. Voor gebruikers van het gratis plan is de aansprakelijkheid beperkt tot €50.

Intellectueel eigendom

Domavix en al zijn bestanddelen zijn het exclusieve eigendom van ABE-HR. Het abonnement verleent een persoonlijk, niet-exclusief en niet-overdraagbaar gebruiksrecht.

Schorsing en beëindiging

Domavix behoudt zich het recht voor de toegang te schorsen bij schending van de AGV. De Gebruiker kan zijn account op elk moment verwijderen via Instellingen.

Overmacht

Geen van de partijen kan aansprakelijk worden gesteld in geval van overmacht. Duurt de gebeurtenis langer dan 30 dagen, dan kan elke partij zonder vergoeding opzeggen.

Wijziging van de AGV

Domavix kan de AGV op elk moment wijzigen. Gebruikers worden minimaal 15 dagen voor inwerkingtreding per e-mail op de hoogte gesteld.

Toepasselijk recht en bevoegde rechtbank

Deze AGV zijn onderworpen aan het Belgisch recht. De bevoegde rechtbanken zijn die van het gerechtelijk arrondissement Brussel. Contact: support@domavix.com

These General Terms of Sale (GTS) govern the relationship between ABE-HR, publisher of Domavix, and anyone subscribing to a paid plan via domavix.com.

Service description

Domavix is a SaaS property management application accessible via web browser on desktop, tablet, and mobile.

Plans and pricing

Prices excluding VAT. Domavix reserves the right to modify pricing with 30 days' notice.

Payment and billing

Payments processed by Stripe Inc. (PCI-DSS level 1). Domavix stores no banking data. Subscriptions billed monthly, automatically renewed.

Renewal and cancellation

Cancellation possible at any time from the Stripe portal. Effective at end of monthly period. No pro-rata refunds.

Right of withdrawal

In accordance with Belgian law (Article VI.53 of the Code of Economic Law), the 14-day right of withdrawal does not apply to digital services where execution has begun with the consumer's express consent.

Availability and maintenance

In case of unavailability exceeding 72 consecutive hours attributable to Domavix, the User may request a credit note.

Liability

Liability limited to subscriptions paid in the last 3 months.

Applicable law and disputes

Belgian law applies. Brussels courts have jurisdiction. EU platform: ec.europa.eu/consumers/odr

Doel en toepassingsgebied

Deze Algemene Verkoopvoorwaarden (AVV) regelen de relatie tussen ABE-HR, uitgever van Domavix, en iedereen die een betaald abonnement afsluit via domavix.com.

Domavix is een SaaS-applicatie voor vastgoedbeheer toegankelijk via webbrowser op desktop, tablet en mobiel.

Abonnementen en tarieven

Prijzen exclusief btw. Domavix behoudt zich het recht voor tarieven te wijzigen met 30 dagen opzegtermijn.

Betaling en facturering

Betalingen verwerkt door Stripe Inc. (PCI-DSS niveau 1). Domavix slaat geen bankgegevens op. Abonnementen maandelijks gefactureerd, automatisch verlengd.

Verlenging en opzegging

Opzegging op elk moment mogelijk via het Stripe-portaal. Van kracht aan het einde van de maandelijkse periode. Geen pro-rata terugbetalingen.

Herroepingsrecht

Overeenkomstig artikel VI.53 van het Belgisch Wetboek van Economisch Recht is het herroepingsrecht van 14 dagen niet van toepassing op digitale diensten waarvan de uitvoering is begonnen met uitdrukkelijke toestemming van de consument.

Beschikbaarheid en onderhoud

Bij onbeschikbaarheid van meer dan 72 opeenvolgende uren toe te schrijven aan Domavix, kan de Gebruiker een creditnota aanvragen.

Aansprakelijkheid

Aansprakelijkheid beperkt tot de abonnementen betaald in de afgelopen 3 maanden.

Toepasselijk recht en geschillen

Belgisch recht van toepassing. Rechtbanken van Brussel bevoegd. EU-platform: ec.europa.eu/consumers/odr
